Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and FCPO Journal ("we", "us", "our", "the Company") governing your access to and use of the FCPO Journal platform, including the web application, API, and all related services (collectively, "the Service").

By creating an account, accessing the platform, or using any part of the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.

Description of Service

FCPO Journal is a professional trading journal platform designed specifically for traders of FCPO (Crude Palm Oil) futures contracts traded on Bursa Malaysia Derivatives. The Service provides tools for:

• Logging and reviewing trade entries and exits with associated metrics
• Tracking performance statistics including R-multiples, win rate, profit factor, and MAE/MFE
• Documenting trading strategies, rules, and psychological notes via the Playbook module
• Managing single or multiple trading accounts via the Portfolio tracker
• Accessing educational content published by administrators or assigned coaches
• Analysing performance breakdowns by setup type, session, market context, and trading quality

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will make reasonable efforts to notify users of material changes via email or in-app notification.

Account Registration

Registration Requirements

To access the Service, you must register for an account by providing a valid email address, a secure password, and your name. You agree to provide accurate, current, and complete information and to keep your account information updated.

Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must:

• Use a strong, unique password of at least 8 characters
• Not share your account credentials with any third party
• Notify us immediately at support@fcpojournal.com if you suspect unauthorised access to your account
• Log out of shared or public devices after each session

We will not be liable for any loss or damage arising from your failure to maintain account security.

One Account Per User

Each user may maintain only one account. Creating multiple accounts to circumvent plan limitations or subscription restrictions is prohibited and may result in termination of all associated accounts.

Account Suspension

We reserve the right to suspend or terminate any account that we determine, in our sole discretion, to be in violation of these Terms, without prior notice.

Subscription & Billing

Available Plans

The Service is offered under the following subscription tiers:

Billing Cycle

Paid subscriptions are billed on a monthly basis. Your subscription period begins on the date of your first successful payment and renews every 30 days thereafter. Your account will display the exact expiry date of your current billing period.

Automatic Renewal

Subscriptions paid via Card or Touch 'n Go (Razorpay subscription) renew automatically at the end of each billing cycle. You will be charged the then-current plan price on your renewal date unless you cancel before the renewal date.

Subscriptions paid via FPX Online Banking are one-time charges per billing cycle and do not renew automatically. You must manually renew before expiry to maintain uninterrupted access.

Plan Changes

• Upgrades — take effect immediately. Proration credit for unused days on your current plan is applied to reduce the charge for the new plan.
• Downgrades — scheduled for the end of your current billing period. You retain full access to your current plan until the period ends.
• Cancellation to Free — your account reverts to the Free plan at the end of the current billing period. Data above Free plan limits is preserved for 30 days and then subject to the Free plan data retention policy.

Free Plan Data Retention

Accounts on the Free plan are subject to a 7-day rolling data retention policy. Trade records older than 7 days may not be accessible on the Free plan. Upgrading to a paid plan restores full access to all previously recorded data.

Payments & Refunds

Payment Processing

All payments are processed through Razorpay (Curlec) via the following methods available to Malaysian users:

• FPX Online Banking — direct debit from your Malaysian bank account, one-time per billing cycle
• Credit / Debit Card — Visa and Mastercard, processed as a recurring subscription
• Touch 'n Go eWallet — processed as a recurring subscription

All prices are quoted in Malaysian Ringgit (MYR). By providing payment information, you represent that you are authorised to use the payment method provided.

Failed Payments

If a recurring subscription payment fails, we will attempt to notify you via email. Your account will remain active for a short grace period. If payment is not received within the grace period, your account will be downgraded to the Free plan. You may reactivate your paid plan at any time by completing a new payment.

Refund Policy

• You were charged in error due to a technical fault on our platform
• You were charged for a plan you did not subscribe to
• The Service was unavailable for more than 72 consecutive hours during your paid billing period due to issues on our end

To request a refund, contact us at support@fcpojournal.com within 7 days of the charge with your account email and transaction reference. Approved refunds will be processed within 14 business days to the original payment method.

Price Changes

We reserve the right to change subscription prices with at least 30 days' notice communicated via email and in-app notification. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

Acceptable Use

You agree to use the Service only for its intended purpose — as a personal trading journal and analytical tool. The following activities are strictly prohibited:

1. Using the platform to provide financial advice, investment recommendations, or trading signals to third parties
2. Sharing your account credentials with others or allowing multiple people to use a single account simultaneously
3. Attempting to reverse engineer, decompile, or extract source code from the platform
4. Using automated scripts, bots, or crawlers to access or extract data from the platform without written permission
5. Uploading content that infringes intellectual property rights, contains malware, or is unlawful, defamatory, or abusive
6. Attempting to gain unauthorised access to other users' accounts or data
7. Reselling, sublicensing, or commercially exploiting the Service or any data derived from it
8. Using the Service in any manner that could damage, disable, or impair our servers or networks
9. Creating accounts to evade a prior suspension or circumvent plan restrictions

Violation of these terms may result in immediate account suspension or termination without refund.

Your Data

Data Ownership

You retain full ownership of all trade data, notes, screenshots, and other content you upload or create within the Service ("Your Content"). We claim no ownership over Your Content.

Licence to Operate the Service

By uploading content to the platform, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the Service to you. We do not sell, share, or use Your Content for any other purpose.

Data Storage

Your data is stored on secured servers. Screenshot uploads are subject to the storage limits of your plan (1 GB for Pro and Elite). Exceeding storage limits may result in the inability to upload additional screenshots until storage is reduced.

Data Export

Pro and Elite subscribers may export trade data to CSV at any time from within the platform. We encourage you to maintain your own backups of important data.

Account Deletion

You may request deletion of your account and all associated data at any time via the Settings page or by emailing support@fcpojournal.com. Account deletion is permanent and irreversible. All Your Content will be permanently deleted within 30 days of the request. Anonymised, aggregated analytics data may be retained.

Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Intellectual Property

Our Property

The FCPO Journal platform, including its design, software, algorithms, interface, branding, and educational content published by our team, is the exclusive property of FCPO Journal and is protected under applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of our platform without prior written consent.

Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us an irrevocable, perpetual, royalty-free licence to use such feedback for any purpose, including improving the Service, without compensation to you.

Coach-Published Content

Educational content published by coaches (Tutor accounts) within the platform remains the intellectual property of the respective coach. By publishing content on the platform, coaches grant us a licence to display that content to their authorised students. Coaches are solely responsible for ensuring their published content does not infringe third-party rights.

Disclaimer of Warranties

Specifically, we do not warrant that:

• The Service will be uninterrupted, error-free, or available at all times
• Any data, statistics, or calculations provided by the Service are accurate, complete, or suitable for any particular trading purpose
• The Service will meet your specific requirements or expectations
• Any bugs or errors in the Service will be corrected within any specific timeframe

You acknowledge that trading FCPO futures carries a high degree of risk and that the Service is a journaling tool only. Any reliance on data or analytics within the platform for actual trading decisions is entirely at your own risk.

Limitation of Liability

To the maximum extent permitted by applicable law, FCPO Journal and its directors, employees, and agents shall not be liable for any:

• Trading losses incurred as a result of using, or inability to use, the Service
• Loss of data or corruption of Your Content
• Indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service
• Unauthorised access to or alteration of your data by third parties

Where liability cannot be excluded under law, our total liability to you for any claim arising out of or related to these Terms or your use of the Service shall not exceed the total amount paid by you for the Service in the 3 months immediately preceding the event giving rise to the claim.

Termination

Termination by You

You may terminate your account at any time by deleting your account from the Settings page or by contacting us at support@fcpojournal.com. Termination does not entitle you to a refund for any unused portion of a paid subscription period.

Termination by Us

We may suspend or terminate your account immediately and without notice if we determine that you have violated these Terms, engaged in fraudulent activity, or if continued access poses a risk to the security or integrity of the platform or other users.

We may also terminate the Service entirely with 60 days' written notice to all active subscribers. In such an event, a pro-rated refund for the unused portion of any paid subscription will be issued.

Effect of Termination

Upon termination, your right to access the Service ceases immediately. Your data will be retained for 30 days following termination, during which you may request an export. After this period, all data is permanently deleted.

Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Malaysia. You agree to submit to the exclusive jurisdiction of the courts of Malaysia for the resolution of any dispute arising from these Terms or your use of the Service.

Before initiating formal legal proceedings, we encourage you to contact us at support@fcpojournal.com to attempt to resolve any dispute informally. We will make a good-faith effort to resolve all disputes within 30 days of receiving your written complaint.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Send a notification email to all registered users
• Display an in-app notice for at least 14 days before the changes take effect

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the updated Terms, you must stop using the Service and may terminate your account.

For minor changes (such as typographical corrections or clarifications that do not materially affect your rights), we may update the Terms without specific notice.
